North Forest Commons Declaration of Restrictive Covenants Lots 111 thru 223 Following is a summary of certain items contained in the Restrictive Covenants of North Forest Commons (Lots 111 thru 223). Please do not rely on this summary as a representation of the Covenants. Instead, please refer to the recorded documents for details and clarifications. o NORTH FOREST COMMONS MAINTENANCE ASSOCIATION: All owners of lots in Sections 4 thru 9 of North Forest Commons are members of the North Forest Commons Maintenance Association. The Association is a not-for-profit corporation with mandatory membership. The maintenance assessment is approved annually and is currently Two Hundred Fifty Dollars ($250.00) per year. o ARCHITECTURAL CONTROL: No house shall be erected, placed or altered on any lot in North Forest Commons until: (1) the construction plans and (2) the builder have been approved by the Architectural Committee. o SPECIAL PROVISIONS DURING CONSTRUCTION: It is the responsibility of the OWNER of any home site to MAINTAIN A CLEAN AND SAFE CONSTRUCTION SITE. Prior to final approval of house plans, the builder must agree in writing to comply with the erosion control plan for North Forest Commons and agree to perform the required activities as outlined by the Architectural Control Committee. This includes installing a stone driveway area prior to commencement of construction activities and steps to minimize mud and debris carryover to the streets and adjacent lots, including the roping off of adjacent vacant lots, if any. o DWELLING: The ground floor of the main structure, exclusive of porches and garages, shall not be less than Two Thousand Three Hundred (2,300) square feet in the case of one story structures, nor less than Twelve Hundred (1,200) square feet in the case of multiple story structures, with no less than Twenty-Eight Hundred (2,800) square feet of finished floor area in such multiple story structures. Basements, either finished or unfinished, shall not be included in square footage calculations. In addition to the above square footage requirements, each structure shall have an attached garage with at least 440 sq. ft. of floor area. No detached garages or other outbuildings are permitted. The exterior first floor walls of the residence must have at least ninety percent (90%) brick or stone coverage (single and multiple story homes). No Aluminum or vinyl siding is permitted. Roof pitch must be at least 9/12 with a minimum overhang of 12 inches although the Architectural Committee may waive this requirement in certain situations. All windows must be constructed of wood. All garages must have finished interior walls. Foundations must have basement or crawl space construction. o TIME LIMITS FOR CONSTRUCTION: There is not a time requirement to begin construction of a residence after lot purchase. Lot owners, however, must keep their lots mowed, cleared of trash and, at the discretion of the Association, may be required to install the sidewalk after one year of ownership to maintain sidewalk continuity throughout the community. o VEHICLE REGULATIONS: No vehicle of more than 3/4 ton hauling capacity or equivalent vehicle shall be parked on any home site except while making a delivery or pickup. No trailer, boat or recreational vehicle shall be permitted to remain on any home site unless kept within a garage. Routine on-street parking is prohibited except that in instances when guest parking is required for special occasions, on-street parking is permitted but vehicles must be removed as soon an the event ends and should not be parked on the street overnight. o ANIMALS: No more than two household pets are permitted per residence. However, additional pets are permitted if kept within the residence at all times. Any dog that is permitted outside MUST remain within a fenced yard (no outdoor animal kennel is permitted). o FENCES: No fence shall be erected between the front property lines and the front of the dwelling, or in the case of a corner lot, between the side property line along the street and the dwelling, except that short sections may be approved for landscaping purposes at the discretion of the Architectural Committee. Any fence that is intended to block the view, such as a privacy fence higher than forty-eight (48) inches, shall be located no further from the residence than midway from the residence and the property line (both side and rear). No fence shall be located within any drainage easement. Any metal or chain-link fence must be covered with black or brown vinyl and may not exceed forty-two (42) inches in height.
